These Terms and Conditions have been created, and are operated by TSDesign Eu Ltd, 11  Tudor Avenue, Stanford-Le-Hope, Essex, SS17 8BX (“We” “Us” and “Our”), for use by anyone registered to use the TSDesign Eu Ltd Website (“Website”). “You” and “Your” shall mean you, the person registered and using the Features.

1. Posting of Materials

Once your application to join TSDesign Eu Ltd has been approved, you may submit samples of your work, you may wish to display on Our website, and post tags and notes on specific items within the Website.

a) We reserve the right to select material to be posted and to approve tags and notes.

b) You acknowledge that: any Material posted is done so at your own risk; and we cannot guarantee the continued availability of your Material within the Features.

c) According to our terms and conditions no full names or contact information can be displayed alongside any material posted.

2. Our User “DOS” and “DON’TS.”

a) Do comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, export control laws, tax laws, and regulatory requirements.

e) DO NOT publish any of your personal information such as your full name, your email address, phone number or street address, or other contact information of this nature.

We reserve the right to keep POSTS anonymous to protect the interest of TSDesign Eu Ltd, the privacy of creative associates and prospective employers alike.

g) DO NOT act dishonestly or unprofessionally by engaging in unprofessional behaviour by posting inappropriate, inaccurate, or objectionable content to our website.

h) DO NOT publish inaccurate information in the designated fields on the profile form (e.g, do not include a link or an email address in the name field).

i) DO NOT create a user profile for anyone other than a natural person;

3. Rights and Permissions

a) You hereby grant us a non-exclusive, worldwide, royalty-free, irrevocable licence to use Your Material within the Features. For the avoidance of doubt, we will not use your Material for any other commercial purposes than to promote your work and services offered by TSDesign Eu Ltd, or for any purpose other than that set out in this clause.

b) We reserve the right to:  change or remove the Features without notice at any stage if We deem this necessary or circumstances arise that are outside our control; and remove any Material that does not comply with Our terms and conditions which disallows negative comments on other creative associates work and any other comment which may damage the “company” – i.e. TSDesign Eu Ltd Any decision to remove such material is final and no correspondence will be entered into.

4. Information liability 

a) You warrant that you have full right, power and authority to provide the Material and that such Material does not infringe any third party rights.

b) You hereby indemnify us against any actions brought against us for any alleged infringement of third party rights arising from the use of the Material within the Features.

c) Any information you submit to us is at your own risk of loss. By providing information to us, you represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights.

6. Your Rights.

a) On the condition that you comply with all your obligations under this Agreement, including, but not limited to, the Do’s and Don’ts listed in Section 2, we grant you a limited, revocable, nonexclusive, non-assignable, non-sublicense able  license and right to access the Services, through a generally available web browser, mobile device or application (but not through scraping, spidering, crawling or other technology or software used to access data without the expressed written consent of TSDesign Eu Ltd.

7. Termination

a) Misuse of the Services.
TSDesign Eu will terminate the account of any User who abuses or misuses the Services. Misuse of the Services includes not following the OUR USER “DOS” and “DON’TS”, abusing our post messaging services; creating multiple or false profiles; using the Services commercially without TSDesign Eu Ltd.

b) TSDesign Eu Ltd may terminate the Agreement and your account for any reason or no reason, at any time, with or without notice. This cancellation shall be effective immediately or as may be specified in the notice. Termination of your TSDesign Eu Ltd account includes disabling your access to TSDesign Eu Ltd and may also bar you from any future use of https://tsdesign.global website.

c) You may terminate this Agreement, for any or no reason, at any time, with notice to TSDesign Eu Ltd . This notice will be effective upon our processing of your notice.

We take the theft of our original work very seriously and would draw to your attention it is protected under UK copyright law. Please note we always sue for compensation if any part of our website, design or seo whether text or images, are found being used without prior authorisation in writing.

9. General

If You use the Features You are deemed to have agreed to abide by all of the following Terms and Conditions together with any amendments thereto (both of which are non-negotiable) under which the Features are offered, and to be bound by them. Breach of any of these Terms and Conditions or any revised Terms and Conditions that We may from time to time impose may result in the blocking of Your access to the Website.

10. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with English law. You hereby submit to and agree that the sole jurisdiction and venue for any actions that may arise under or in relation to the subject matter hereof shall be the English courts.
